Publisher Membership Agreement Update
Most Recent Changes
LinkShare revised the UK Publisher Membership Agreement (“Agreement”) effective at 5:00 p.m. (EST) on October 6, 2011 (“Effective Date”). The key revisions to the Agreement are as follows:
1) Section 4.11 & 20.1: Gives explanation of LinkShare acting as a limited commercial agent with respect to the collection of commissions from Network Advertisers on Your behalf;
2) Section 5.3: Discusses the process and implications on disputes with Network Advertisers.
3) Section 5.4: Gives explanation on consumer information collected by LinkShare in the tracking process;
4) Section 5.5: Discusses Your obligations to include certain disclosures in Your site’s Privacy Policy with respect to the use of cookies and other tracking devices (including 3rd party cookies/tracking devices enabled by LinkShare at your request on Your site). As Your site is consumer-facing, You will now be required to obtain consent from End Users for placement of cookies (including LinkShare cookies/tracking devices) on such End Users’ computers;
5) Section 6.5: Added reference to the applicable UK anti-spam laws; and
6) Section 11.5: Added Exchange Rate risk provision;
If you wish to continue to use any LinkShare Network and/or LinkShare Offering on or after the Effective Date you will be deemed to have accepted the revised terms. If you do not wish to accept the revisions to the Agreement, you must terminate your Agreement in accordance with the specific termination provisions of your Agreement.
